This morning, the Judge of the Court of First Instance ruled in the summary proceedings that the electric scooter rental companies in the hotel sector, E-Bike and Green Bike, initiated against the Government. This is related to the Minister of Justice’s decision to remove all scooters from the road, as they allegedly pose a danger to traffic and the users themselves. It was understood that the Judge pointed out to the Government that it must act based on the law and that the way it acted was incorrect.

The Sentence In the ruling, the Judge indicated that on April 21, 2026, the Minister of Justice announced an immediate ban on the use of electric scooters on public roads. On April 29, 2026, a “Final Notice” from the Minister was published on social media, and on April 30, 2026, the Government ordered the removal of the electric scooters. The companies E-Bike and Green Bike asked the Judge to prohibit the Government from confiscating the electric scooters. The Government disagreed and filed a counterclaim requesting that the companies remove all electric scooters and charging stations from government property.

Must act according to the law The Judge’s decision in this summary case is that, at this moment, the Government cannot remove the electric scooters. The Judge pointed out that if the Government wants to take measures against the electric scooters, this must happen carefully and according to the procedures stipulated by law. In this case, it means that the Government must send a letter to the companies, announcing (and explaining why) the Government believes the companies are acting against the law. The Government must specify which law is involved and what measures the companies must take. Additionally, the Government must stipulate a period within which the companies must comply. The Judge noted that the Government did none of this in this case.

Cannot remove scooters and charging stations The Judge further stated that the court decided that the electric scooter rental companies are not obliged to remove the scooters and charging stations from public roads at this time. The Judge pointed out that here, too, the Government must first send a letter to the companies requesting the removal of their property from government land within a reasonable timeframe.

Companies must adhere to current rules The Judge pointed out that this decision does not mean that electric scooters can remain on public roads forever. The Judge noted that, naturally, the companies renting out electric scooters must adhere to the current rules. This also applies to the riders of the scooters. The Judge indicated that the ruling means the Government cannot simply act and remove electric scooters while the Government itself does not follow the rules stipulated by law.
