Minister Dowers: Government has filed a complaint regarding irregularities in RDA and awaits the Judge’s decision regarding an investigation

The Minister of Justice, Arthur Dowers, confirmed that the Government of Aruba has filed a formal complaint regarding indications of possible irregularities at RDA.

According to Minister Dowers, after receiving information concerning these indications, the Government followed the legal procedures and submitted the complaint to the Public Prosecutor’s Office for evaluation.

Minister Dowers explained that the Public Prosecutor’s Office subsequently communicated that the complaint would not proceed with an investigative procedure, citing operational capacity limitations as the reason for the decision.

“This is a decision that belongs exclusively to the Public Prosecutor’s Office,” Minister Dowers stated.

He indicated that, in accordance with available legal mechanisms, the person or entity filing the complaint has the right to appeal to a Judge and request that an investigation take place.

According to Dowers, that is precisely the next step the Government has taken.

“Now we are awaiting the Judge’s decision regarding the request to instruct the Public Prosecutor’s Office to proceed with the investigation.”

Minister Dowers expressed that unfortunately, staff limitations can result in an investigation not moving forward, emphasizing that it is important for the legal process to follow its course to bring clarity to the matter.

He concluded by stating that the Government respects the independence of the judicial authorities while awaiting the Judge’s ruling.
