The “Boogeyman” of Financial Supervision: Worse Than the 2014 Budget
Oduber reminded the public that the current situation is much more serious than the 2014 crisis, when Prime Minister Mike Eman went on a hunger strike against the Netherlands due to the signing of the budget.
“Back then, I stood by his side, I believed in it, because I was of the opinion that the Netherlands could not interfere,” Oduber explained. “But today we are talking about a ‘boogeyman’ that is a thousand times larger and worse than a budget.”
The PPA leader questioned the stance of AVP leader Mike Eman, who recently declared during a pre-election debate that he is against the Rijkswet HOFA (Kingdom Law HOFA). Oduber finds it contradictory that this position is only being taken now, during the electoral campaign, while the legal danger is already knocking on the door.
The Strong Concept of the Advisory Council (Raad van Advies)
Oduber explained that public finance is a landsangelegenheid—an internal matter of Aruba structurally protected by Article 43 of the Kingdom Charter (Statuut). The attempt to use Article 38 of the Charter to pass this supervision with a simple majority of just 11 votes in Parliament is, according to him, an unconstitutional act.
“You cannot regulate something within a National Ordinance (Landsverordening) with a parliamentary majority of 11 people when that something is embedded in your Constitution (Staatsregeling). If you accept this, you are going against your own Constitution,” Oduber emphasized.
According to the PPA party leader, to change these rights, a qualified two-thirds (2/3) majority in Parliament is required. Knowing that this is not legally built into the current constellation, the Netherlands is opting for a “backdoor” approach.
Surrendering Autonomy for a “Bag of Money”
The most critical point in Oduber’s statement involves the financial conditions that The Hague is imposing on Aruba, especially regarding loans and debt refinancing. Oduber used heavy words to describe this tactic:
“The blackmail happens when they say: ‘I will give you a bag of money so you can gift and sell me this autonomy, allowing me to gain authority over you.’ That is what the community needs to understand,” Oduber concluded, warning that the future of Aruba’s legislative and financial sovereignty faces imminent danger if this pressure is allowed to pass so easily.
