Minister Wever seeks Parliament’s stance on the political direction the Government intends to take regarding the Top Incomes Standardization Act (LNT)
The LNT was introduced in 2022 as a condition set by the Netherlands for the liquidity support Aruba received during the COVID-19 crisis. The law’s objective is to curb excessive salaries in the public and semi-public sectors, particularly among top-level officials. In practice, however, the LNT has led to multiple challenges; several entities and companies have initiated legal proceedings against its application, highlighting the need to clarify or amend the legislation.
An unprepared meeting and a lack of information Minister Wever proposes amending the LNT to, among other things, remove several companies and entities from the law’s scope. Yet, during the session, it became evident that Minister Wever was not adequately prepared for the required debate, as he lacked a substantial amount of relevant information.
For instance, Parliament was not provided with an evaluation of the LNT’s performance since its entry into force. The Minister failed to detail the legal cases brought against the LNT—how many exist, the legal grounds discussed, which cases were won or lost, the legal and financial ramifications of each decision, which specific provisions need amending, and which entities would remain subject to the LNT once revised. Ultimately, vital information necessary for Parliament to form a responsible judgment was absent.
Need for sound analysis and data This legislation impacts public funds management, executive salaries, and trust in public administration. Consequently, any modifications must be grounded in analytical data and legal and financial counsel, rather than political preference alone.
MP Maduro stresses that while the LNT may require revision, changes must deliver greater clarity, equality, and legal certainty. If the Government exempts nearly all major entities from the law without a thorough evaluation, the LNT risks losing its underlying purpose and effectiveness.
“Minister Wever did not come to Parliament with the necessary information. The meeting itself confirmed that the Government still has considerable work to do on this front. Before Parliament can adopt a responsible position, the Minister must present a comprehensive evaluation, the outcomes of all legal cases, and a concrete proposal detailing exactly what will change, why, and for whom.”
The public has a right to know how public funds and public-sector salaries are safeguarded. A law of this magnitude cannot be amended without proper information. The process must be transparent, well-prepared, and legally sound.
