The Public Prosecution Service has decided to file an appeal in the criminal case known as “Rixa”, in which the defendant, C.E., was charged on March 13, 2025, with human trafficking, human smuggling, and the illegal employment of three individuals during several periods in 2024 and 2025.
The Court sentenced the defendant to ten months’ imprisonment, of which four months were suspended with a probation period of two years, and imposed a fine of AWG 5,000. In addition, the judge acquitted the defendant of the charge of human trafficking. The appeal is primarily directed at this part of the verdict.
The Public Prosecution Service considers the reasoning behind the acquittal on the charge of human trafficking to be insufficient. The Court’s considerations were so brief that it remains unclear to the prosecution on what grounds the acquittal was reached. Given the seriousness of human trafficking as a crime against personal freedom and its societal impact, the Public Prosecution Service deems further review by the Court of Appeal necessary.
Moreover, the ruling could lead to confusion within society, particularly among bar owners employing women in the sex industry. At present, it is unclear what legal framework applies and what is or is not permitted in the treatment of workers in this sector. The Public Prosecution Service considers it of great importance that clarity is provided on this matter, both legally and socially.
