Defense disagrees with the Court of Appeal ruling and supports taking the case to Cassation before the Supreme Court (Hoge Raad)

A detailed analysis of the ruling recently issued by the Joint Court of Justice (Hof) highlighted several critical points which, according to Otmar Oduber’s defense team, show that this legal decision is incomplete and contains substantial flaws. Following an evaluation of its contents, it was confirmed that this legal fight has not come to an end, as the case will now be brought before the Supreme Court of the Netherlands (Hoge Raad) through a cassation procedure.

Three main points of objection

The disagreement with the ruling is primarily based on three main arguments that challenge the reasoning and assessment of evidence by the Court of Appeal:

  1. Arguments left unconsidered and unexplained: The Court did not address the details of all defense points presented. Furthermore, the court failed to provide reasoning or explanation as to why it chose not to take these defense arguments into account.
  2. Use of contradictory evidence: Certain pieces of evidence from the case file were utilized, even though within that same file there are other pieces of evidence proving the exact opposite.
  3. Lack of reasoning for the conviction: The Court concluded that there was sufficient evidence to reach a conviction; however, it failed to explain and substantiate the reasoning behind that conclusion.

Relying solely on the National Detective Service (Landsrecherche) while ignoring witnesses

One of the most noticeable flaws in this process, according to the defense, is that the Court relied almost exclusively on the investigation and case file presented by the National Detective Service (Landsrecherche), without giving due weight to the statements of over 25 witnesses who were questioned and directly contradicted the official version.

In several instances, the initial interrogations by the Landsrecherche lacked clarity. When these witnesses appeared before the Examining Judge (Rechter-Commissaris – RC), they clarified their statements, demonstrating that the Landsrecherche notes were inaccurate or had been misinterpreted. Therefore, the fact that the Court chose to ignore these clarifications before the Examining Judge and stick solely with the Landsrecherche version is considered a major flaw that is unusual in the administration of justice.

Taking the step to Cassation before the Supreme Court (Hoge Raad)

After Otmar made the personal decision to file for cassation, this choice received full support from his legal team. Although the cassation process requires a specialized attorney in the Netherlands, preliminary evaluation indicates clear legal errors that must be reviewed.

The role of the Supreme Court (Hoge Raad) in a cassation proceeding is not to re-evaluate the facts or evidence of the case, but purely to verify two fundamental aspects:

  • Whether the Court of Appeal applied the law correctly.
  • Whether the ruling was adequately and logically reasoned.

If the Supreme Court rules in favor of the defense and overturns the sentence, the case will be referred back to the Court of Appeal to be retried, opening the path for an objective re-evaluation of all the defense arguments and witnesses that were previously set aside.
