This morning, the Judge delivered a ruling in the administrative law (LAR) case brought by Friendly Green Bike (Green Bike) and Evikes Corporation (Evikes) against the Government. It is understood that the Judge rejected the lawsuit filed by Green Bike and Evikes.
The companies Green Bike and Evikes were represented by attorney Mr. de Lange, while the Government was represented by Mr. Gravenstijn.
Green Bike and Evikes initiated the legal proceedings to request that the Judge suspend the Government’s order dated June 29, 2026, against both companies. Both businesses objected to this order. The order effectively constitutes a fine imposed by the Government on Green Bike and Evikes for failing to comply with established regulations—specifically, the requirement to possess a permit to rent out electric scooters and bicycles, which the companies do not have.
Judge’s Evaluation
In the evaluation, the Judge pointed out that Green Bike and Evikes asked for the Government’s fine to be suspended for a period of six months until a final decision is reached regarding their permit applications. The companies argued that if the Government’s order is not suspended, they will suffer financial harm because customers will be unable to use their services.
On behalf of the Government, it was argued that the Judge should dismiss the request because there is no matter of urgency. The Government maintains that it must act because traffic safety is at risk.
The Judge noted in the evaluation that public transportation law prohibits renting out vehicles without a permit from the Minister of Transport and Communication. The Judge also highlighted that the law dictates fines may be imposed for failure to comply with regulations.
Judge’s Decision
The Judge found that there was no urgent cause regarding the financial situation as claimed by Green Bike and Evikes. In the Judge’s opinion, while the financial records presented by Green Bike and Evikes suggest that both companies are under pressure, the documents do not clearly demonstrate the precise moment at which they would no longer be able to meet their financial obligations. The Judge further noted that the commercial interests of Green Bike and Evikes do not outweigh the public interest, which encompasses adherence to permitting regulations and overall traffic safety.
