The Government of Aruba has taken note of the Court’s decision in the case between ABC and the Country of Aruba, regarding the balance between environmental protection and activities within the tourism sector.
In its ruling, the Judge highlighted that all involved interests must be taken into consideration: ABC’s interest in protecting flora and fauna within legally protected areas, the tour operators’ interest in the continuity of their business activities, the Government of Aruba’s responsibility to protect legally designated natural areas, and the general interest of the Aruban community. The Judge emphasized the importance of achieving a proper balance between nature conservation and the tourism industry.
To allow space for a reasonable and workable solution, the Judge decided to postpone the proceedings for 5 weeks, until Thursday, October 15, 2026, at 2:00 p.m.
As a condition, the Country of Aruba must set a date and time today within the coming week to sit down with ABC, as the plaintiff in the proceedings, for a constructive dialogue and, if necessary, hold multiple meetings. The Judge expressed that all parties, including tour operators, must demonstrate a willingness to come together and contribute to a solution that considers the various interests and functions effectively in practice.
The Government of Aruba respects the Court’s decision and is committed to complying with the directions provided. The Government continues to view dialogue as the best path to reach a solution that protects our nature, while simultaneously accommodating economic activity and the general interest of Aruba.
