In a serious case of abuse: Detention suspended due to incompatibility

The investigative judge (commissaris-commissaris) suspended the detention this afternoon of the man L.S.H., who is suspected of abusing a 79-year-old person at a nursing home during the night of July 16 to 17.

This is a serious case in which an elderly adult suffered severe injuries. The investigative judge ordered the suspension of suspect H.’s detention after it was established that this man is not fit to remain detained, meaning he is incompatible with detention. He was sent home with conditions. A suspect is considered incompatible with detention when their physical or mental state does not allow them to remain detained in a safe and responsible manner. In this case, suspect H. depends on 24/7 care, which cannot be provided either at the Police Station or at the Detention Center (Huis van Bewaring). Furthermore, there are no other adequate facilities in Aruba to detain a suspect in the medical condition this person is in. In such situations, the investigative judge can decide to suspend detention and impose conditions. The investigative judge imposed certain conditions on the suspect in question. He must remain available to Justice, while the Public Prosecution Service investigates the possibilities of detaining him again. Arriving at a solution will take time, because Aruba depends on the Netherlands to house H. in an appropriate detention facility, and such a transfer cannot be arranged in the short term. At the same time, as indicated previously, the Police Station is not an appropriate place to detain this person. Therefore, the Public Prosecution Service, with great displeasure, let suspect L.S.H. go for now, but will continue working to find a detention place for him so that he can be detained again.
